SPECIAL CONDITIONS
“SOLAR ECLIPSE BOAT EXPERIENCE – 12 AUGUST 2026

These Special Contracting Conditions exclusively govern the booking, purchase, cancellation and provision of the extraordinary event called “Solar Eclipse Boat Experience – 12 August”, marketed through www.palmacruises.com, and supplement the General Terms and Conditions of the website.
In the event of contradiction, these special conditions shall prevail over the general ones.
1. Nature of the contracted service
The activity offered consists of an extraordinary recreational maritime excursion linked to the observation of the solar eclipse on 12 August, with departure on a specified date, time and port.
This is a leisure and entertainment service linked to a specific date, with limited capacity, specific logistical planning, and prior allocation of human resources, fuel, crew and vessel.
Consequently, the booking is subject to these special conditions.
2. Express exclusion of the right of withdrawal
In accordance with article 103.l) of Spanish Royal Legislative Decree 1/2007, as this is a service related to leisure activities scheduled for a specific date, the fourteen (14) calendar day withdrawal right generally applicable to distance contracts does not apply.
Therefore, once the booking is confirmed and payment has been made, the customer expressly acknowledges and accepts that:
- the booking is firm and final
- no withdrawal right applies
- there is no unilateral cancellation right with refund
- the seat is nominally blocked for the event date
3. Cancellation, changes and no-show policy
The booking corresponding to the special event Solar Eclipse Boat Experience – 12.08 shall be considered NON-REFUNDABLE.
No full or partial refund of the amount paid shall be granted in any of the following cases:
- voluntary cancellation by the customer
- error in the selected date
- unforeseen inability to attend
- delay in arriving at the boarding point
- missed flights, transport or connections
- illness, indisposition or personal reasons
- errors in passenger data entry
- failure to appear on time (no-show)
- voluntary abandonment of the activity once started
Likewise, no date changes will be accepted, as this is a unique and non-repeatable astronomical event.
4. Weather, maritime and safety conditions
TRAMONTANA SL reserves the right to modify, delay, shorten, reschedule or cancel the departure whenever circumstances arise that compromise maritime safety.
In such cases, the company may offer, at its sole discretion:
- voucher for the full amount
- change to an equivalent experience
- alternative departure
- full refund
The company’s decision shall be adopted according to nautical safety and operational criteria.
5. Eclipse visibility and no guarantee of the phenomenon
The customer expressly acknowledges that the main contractual object consists of providing a themed maritime astronomical observation experience from the vessel, and not guaranteeing the visual result of the celestial phenomenon.
Therefore, TRAMONTANA SL:
- does not guarantee total or partial visibility of the eclipse
- does not guarantee absence of clouds, haze, mist or light pollution
- does not guarantee optimal observation intensity
- is not liable for astronomical or atmospheric phenomena beyond its control
The absence of total or partial visibility of the eclipse due to meteorological or natural causes shall not constitute contractual breach nor entitle the customer to a refund.
6. Customer obligation and punctuality
The customer must present themselves at the indicated boarding point at least 30 minutes before the time stated in the confirmation.
Failure to appear with sufficient time shall be considered a no-show, automatically losing the right to board and any refund.
7. Electronic acceptance and evidentiary value
Online contracting through Stripe or any payment gateway integrated into the website shall require the express acceptance of these Special Conditions by means of a mandatory checkbox prior to payment.
Such acceptance shall have full contractual and evidentiary validity.
TRAMONTANA SL shall retain as evidence:
- date and time of acceptance
- IP address
- provided email
- Stripe payment identifier
- accepted legal text version
- server logs
- confirmation messages
- automatic reminders
- boarding list
- check-in
- photographic proof of the group
All of this may be used as evidence against bank claims, chargebacks, payment gateways, insurers or judicial proceedings.
8. Bank charge identification
The customer accepts that the card charge will appear identified with a commercial description similar to:

Failure to recognise the bank transaction concept shall not invalidate the booking where evidence of reservation and acceptance of terms exists.
9. Governing Law and Jurisdiction
These Special Conditions shall be governed by and construed in accordance with Spanish law.
Any dispute, controversy or claim arising out of or in connection with the interpretation, performance, enforcement or validity of this contract shall be subject to the exclusive jurisdiction of the Courts and Tribunals corresponding to the consumer’s place of residence, without prejudice to any mandatory consumer protection laws and regulations that may apply.
